摘要
沿海捎带业务这一创新政策自上海自贸区成立以来,已试点运行约6 a。该政策逐步被复制推广至全国其他有条件试行的自贸区,取得一定的成效。基于对该创新政策的系统梳理和评估,发现在试行过程中,该政策不可避免会产生适用范围局限、监管机制不完善以及法律适用冲突等问题。在新形势下,为进一步完善我国沿海捎带业务创新政策,提升我国航运业的国际竞争力,需要从系统考察执行效果、平衡海运市场开放和国家安全之间的关系、优化沿海捎带业务监管模式等方面做进一步探讨。
The innovative policy toward coastal piggyback business in container transportation has been piloted for more than six years since the establishment of the Shanghai Free Trade Zone.During the period,the policy has been copied and extended to other conditional trial free trade zones across the country,and some results have been achieved.The systematic review and evaluation of the innovative policy found that in the trial process,there existed,inevitably,problems,for example,in the scope of application and conflict with law application.In the new situation,for further improving China's innovative policy toward coastal piggyback business in container transportation and enhancing the international competitiveness of China's shipping industry,it is necessary to make further discussion in systematical investigation of the implementation effect,and emphasize the balance between opening maritime market and national security,as well as optimizing the supervision mode.
