摘要
研究目的:明确土地征收中被征收人参与的意义与功能,构建被征收人有效参与的制度框架,促进土地征收活动的顺利展开和实现土地征收中的公平正义。研究方法:规范分析法、文献解释法、归纳总结法。研究结果:被征收人有效参与是土地征收制度的重要组成部分,而当前的土地征收程序属于行政主导型模式,被征收人的参与局限于表面、浅层次参与,很难对征收行为施加积极、有效影响。研究结论:应在正当法律程序理念指引下,着重完善信息公开、协商讨论、及时反馈等参与制度,才能更好确保被征收人的有效参与。
The purpose of this study is to clarify the significance and the function of the condemnees’ participation in land acquisition, to construct the intuitional framework, to promote smooth development of land acquisition, and to achieve fairness and justice. The methods of normative analysis, literature survey and inductive abstraction are employed. The results indicate that the effective participation of the condemnees is the important part of land acquisition reform, whereas the current land acquisition procedure features as a government-led mode. Therefore, condemnees can only superficially take part in land acquisition and are unable to exert positive and effective impacts. In conclusion, certain systems should be improved, including information disclosure, coordination and prompt feedback, to ensure the effective participation of condemnees.
