摘要
政府数据开放是整合公共数据资源向社会开放,促进数据增值利用和创新应用的重大措施。目前政府数据开放尚处于起步阶段,面临数据采集汇聚质量不高、数据开放范围不明、数据开放程序不完善、数据应用无影响力和数据安全保护不足等问题,急需强力有效的法律规范予以保障。政府数据开放法律框架的构建应围绕实践需求,以全面优质的数据采集汇聚制度为基础,以促进高效利用的数据开放开发制度为核心,以注重可靠安全的数据安全保护制度为保障。
Government data opening is an important measure to integrate public data resources to open to the society and promote the value-added utilization and innovative application of data.At present,the opening of government data is still in the initial stage,facing the problems of low quality of data collection and aggregation,unclear scope of data opening,imperfect data opening procedures,no influence of data application and insufficient data security protection,etc.,which need strong and effective legal norms to guarantee.The construction of the legal framework of government data opening should focus on the practical needs,be based on the comprehensive and high-quality data collection and aggregation system,be centered on the open development system of promoting efficient use of data,and be guaranteed by the data security protection system that pays attention to reliable security.
