摘要
利用手机App等互联网应用在收集用户个人信息时,应该对告知同意原则作出合理限制。具体而言,告知同意原则要受通信自由和通信秘密宪法权利的限制,要受隐私权的限制,还要受目的原则与必要原则的限制。因此,不能简单地以告知同意原则作为任何情况下不当收集个人信息的合格抗辩。在实践层面,对告知同意原则的合理限制,不应仅仅满足于对隐私政策的评估,更需要进行价值层面的衡量并做出执法和司法上的正确判断。同时,还可以从技术路径及信息主体的自主控制出发,加强对个人私密信息的保护,以实现信息主体个人权益与信息业者经营利益的平衡。

Therefore, the principle of informed consent can not simply be used as a qualified defense for improper collection of personal information in any situation. At the practical level, the reasonable restriction on the principle of informed needs to carry on value measurement and make correct judgments in the law enforcement and justice, rather than satisfying with the assessment of privacy policy only. At the same time, it is also important to strengthen the protection of sensitive personal information from the technical path and the autonomous control of information subject, so as to achieve the balance between the personal rights and interests of information subject and the business interests of the information industry operators.
