摘要
建立法官员额退出机制,具有十分重要的意义。基于北京高院、辽宁高院、山东高院员额法官退出现象进行解读,并对中部H省三级法院员额法官退出情形与退出机制进行调研。基于员额法官退出的现状,从理论和实践上分析构建员额法官退出机制的现实困境。为了破解困境,了解英国、美国、德国、法国等域外国家中考察法官离职情形的经验,并从中寻找借鉴。在域内外考证的基础之上,提出了从理念更新和具体构建两个方面来构建我国的员额法官退出机制。
It is of great significance to establish a mechanism for the withdrawal of judges.Based on the analysis of the withdrawal of post judges from Beijing High Court,Liaoning High Court and Shandong High Court,the withdrawal situation and withdrawal mechanism of post judges from the third-level courts in H province in central China are investigated.Based on the current situation of the withdrawal of post judges,this paper analyzes the practical difficulties in constructing the withdrawal mechanism of post judges in theory and practice.In order to solve the dilemma,we should understand the experience of foreign countries in Britain,the United States,Germany,France and other regions in examining the resignation of judges,and look for reference.On the basis of textual research both inside and outside the domain,this paper proposes to construct the withdrawal mechanism of post judges in our country from two aspects:concept renewal and concrete construction.
