摘要
中国银行法制的完善是一种强制性的制度变迁 ,在当前的国内和国际金融背景下 ,尤其在中国加入WTO后 ,这种金融制度变迁显得尤为迫切和必要。在防范银行恐慌方面 ,中国银行法制既取得了一些成就 ,也存在着问题。中国银行法制应注重法规的可操作性 ;加强自律和透明度方面的立法 ;进一步完善银行借贷中的担保制度 ;加快加强存款保护的立法进程。
The improvement of China's banking legal system is a kind of obligatory institutional transition.It is believed that under the current domestic and international financial circumstance,especially after China's entry into WTO,this kind of financial institutional transition seems to be urgent and necessary.This paper gives a brief retrospect of the establishment and reform of the banking legal system in USA and takes it as an example to draw on.Then an analysis is made of the progress made by China's banking legal system and the main existing problems in connection to the antibank panic. Finally some countermeasures are advanced.
