摘要
已经生效实施的《电子商务法》加强了对知识产权的保护,但由于其未明确规定电商平台的事先专利审查义务,使得电商平台的"明知或应知"规则在实践中难以判断和归责。正在送审的专利法修正案拟增加通知规则,将电商平台对通知内容的事后审查明确为生效裁判文书和决定,加大了权利人的举证责任,不利于对专利权的保护。为此,论文从电商平台的法律地位、法律适用和法律原则出发对电商平台事先专利审查进行论证,并对事先专利审查义务的内容进行建构;对于拟增加的事后审查规则,分别从通知-移除规则的目的、实际可执行性和现行法律制度规定三个方面对其进行解析,最后为专利法修订提出相应的立法建议。
The "E-commerce Law" has been put into effect and implemented to strengthen the protection of intellectual property rights.However,since it does not clearly stipulate the obligation of ex ante patent examination for ecommerce platforms,it is difficult to judge the "knowing or should know" of e-commerce platforms in practice.In addition,notification rules are proposed to be added to the amendment of patent law,which explicitly defines the ex post review of the notice content by e-commerce platforms as effective judgment documents and decisions,increasing the burden of proof for the right holder and being not conducive to the protection of patent rights.This paper demonstrates the ex ante patent examination of the e-commerce platform based on the legal status,legal application and legal principles of the e-commerce platform,and constructs the content of the prior patent examination obligation.As for the proposed ex post-review rules,the paper analyzes them from three aspects: the purpose of the "notification and remove" rules,the practical enforceability and the provisions of the current legal system,and finally puts forward corresponding legislative suggestions for the revision of patent law.
