摘要
中俄建交70年来,两国关系与国际法实践取得了丰厚成果。双边层面,两国国际法实践鲜活地体现了中俄双边关系的继往开来。此类实践集中表现在两国对国家或政府的承认、处理旧约和缔结新约、解决边界争端、缔结和履行其他双边条约等领域。同时,两国在多边框架内也开展了广泛的合作与实践,在参与全球治理体系改革、协调构建国际政治经济新秩序等方面发挥了重要作用。此类实践集中表现为参与国际性和区域性政治经济事务,解决热点问题,建立、运行和改革国际组织或机制等。从两国关系与国际法实践的发展历程来看,中俄国际法实践和两国关系,相互影响又具有独立性,双方角色也有所转变;同时,两国国际法实践虽兼具务实性与创新性等特点,但仍呈现出较明显的不平衡性,容易受到国际环境及第三国的影响。以中俄新时代全面战略协作伙伴关系为新起点,两国关系和国际法实践将续写新篇章。
Since the establishment of diplomatic relations 70 years ago,the relations between China and Russia and the practice of international law have yielded fruitful results.Among them,the practice of bilateral international law vividly reflects the development of Sino-Russian bilateral relations,which is concentrated in the recognition of the state or government,the handling of the old treaties and the concluding of new treaties,the settlement of border disputes,and other bilateral treaty practices;China and Russia have also carried out extensive cooperation and practice within the multilateral framework,and played an important role in participating in the reform of the global governance system and coordinating the construction of a new international political and economic order,focusing on the participation of international and regional political and economic affairs,the resolution of hot issues,and the establishment,operation and reform of international organizations or mechanisms.Judging from the history of development,Sino-Russian international law practice is mutual influent with bilateral international relation but still independent,and the roles of the two countries has also changed.At the same time,although the practice of international law is both pragmatic and innovative,it still presents an obvious imbalance and is easily affected by the international environment and third countries.In general,restarting from the new point of full strategic and cooperative partnership in the new era between China and Russia,the international relation and the practice of international law will continue writing a new chapter.
