摘要
司法如何回应主流价值观是当前加快推进乡村治理体系建设与提高治理能力现代化需要审慎解决的问题。为此学界有很多热议,其主要观点是在国家层面上通过立法将核心价值观写入法条,但这不免会造成司法上法官机械地运用法条,出现判决理由格式化、政治语言泛滥,甚至不公正判决等问题。为了避免此类现象的发生,应该重点从基层法院着手。目前大量涉及核心价值观融入的司法案件,大部分发生在基层法院(或派出法庭)。因此,首先从基层开始落实具体的法律方法,来使核心价值观融入乡村司法才是正确之道。其次,面对大量乡村司法中存在的判决格式化问题,需要加强判决理由作为载体形式的具体适用,才可以进一步获取公众舆论对法官裁判的认可接受。
How to respond to the mainstream values is a problem that needs to be solved carefully in judicial practice in order to speed up the construction of rural governance system and to improve the modernization of the governance capacity. There have been many heated discussions in the academic circles. The main point of view is that the socialist core values should be written into the law by legislation at the national level, but this will inevitably cause the judicial judges to apply law mechanically, have formative judgment reasons, abuse political language and even make unjust judgments. In order to avoid this kind of phenomenon, we should focus on grass-roots courts. At present, a large number of cases involving the integration of core values occur in grass-roots courts (or dispatched tribunals). Therefore, the implementation of specific legal methods from the grass-roots level is the right way to integrate the socialist core values into the rural justice. Second, in the face of the problem of decision-formatting existing in a large number of rural justice practices, it is necessary to strengthen the decision-making reason as the specific application carrier to further obtain the acceptance of the public opinion on judge’s decision.
