摘要
专利侵权合法来源抗辩主要考量主观善意、产品具有合法来源这两个法定要件。对于产品具有合法来源的认定,关键是明晰证明标准,兼顾交易习惯。作为一种善意第三人制度,合法来源抗辩是专利侵权制度的例外。经营者主张合法来源抗辩,应当提供真实完整的证据,符合高度盖然性的证明标准。同时,《电子商务法》的实施对电子商务交易习惯了产生重要影响,也对专利侵权合法来源抗辩提出了新挑战。例如,禁止刷单行为使得交易数据更为真实、交易产品有据可查;经营者形成了提供购货凭证、保管交易记录的习惯,举证能力逐步提升;“通知-删除”规则中,因专利权人没有及时诉讼导致删除链接措施被终止时,电子商务经营者仍享有合法来源抗辩的权利。
The defense right of legitimate source in patent litigation mainly considers two factors: the good intention and the legitimate source of products. The key to consider whether the products have legitimate source depend on the proof standard and the trading habits. Functioning as a bona fide third party system, the defense right of legitimate source against patent infringement is an exception of the patent system. Retailors shall provide true and complete evidence for the defense right of legitimate source, which meets the proof standard of “the high degree of probability”. At the same time, the implementation of the Electronic Commerce Law has an important impact on e-commerce transaction habits and brings new challenges to the defense right of legitimate source in patent litigation. For instance, banning data fraud makes the transaction data more realistic, and the source of e-commerce products can be located. The e-commerce retailors have formed the habit of providing purchase certificates and keeping transaction records, increasing their ability of providing evidence. In the “notice and take down” procedure, even if the patentee failed to sue timely and the deleted link is restored, the e-commerce retailors still hold the defense right of legitimate source in patent litigation.
