摘要
长期以来,海事责任认定是否具有可诉性是一个存在争议的问题。通过对我国当前立法规定以及司法实践的分析,可以得出该问题关键在于判断其是否对当事人权利义务产生了实际影响。通过分析可认定海事责任认定中的事故责任并不是法律责任,其不产生法律上的实际影响,在诉讼和执法中作为证据运用,因而不具有可诉性。
The justiciability of the liability identification for marine accidents has always been a controversial issue. Based on the analysis of the current legislation and judicial practices, it can be concluded that the key to solve this issue is to exam whether there is an actual impact on the rights and obligations of administrative counterparts. Considering that the accident liability, having no actual impact in legal sense, does not equal the legal liability, such liability identification is only used as evidence in lawsuits and law enforcement and is, therefore, not justiciable.
