摘要
本文着重研究专利权出资风险及风险防范。首先通过提出专利权制度的由来来解决专利权的定义,结合专利权出资现状和我国法律相关规定以及立法趋势来分析专利权出资会面临怎样的风险。之后通过研究专利权出资的配置比例,内容及有效期,权利转让等方面具体分析专利权出资面临的法律风险。最后为防范专利权出资风险提出相关建议。
This paper focuses on the risk of patent investment and risk prevention.Firstly,the definition of patent right is solved by putting forward the origin of patent right system,and the risk of patent right investment is analyzed according to the current situation of patent right investment and the relevant provisions of Chinese law and legislative trend.Then,through the study of the allocation ratio,content and validity period of patent investment,rights transfer and other aspects of specific analysis of the legal risks faced by patent investment.Finally,some suggestions are be put forward to prevent the risk of patent investment.
