摘要
目前,我国惩治有组织犯罪系统化立法尚存在理念保守、系统性不强、可操作性不够、缺乏专门法指引、刑事法及相关法滞后等问题。为有效惩治有组织犯罪,需要对刑事法重点完善,对相关法进行补足。在刑事法完善方面,要准确界定有组织犯罪概念,类型化其犯罪构成;将真正的有组织犯罪定位为法定犯,完善其罪刑内容,调整级别管辖,严格强制措施的适用,强化相关主体的法律保护。在相关法补足方面,要科学制定惩治有组织犯罪法,完善立体防御的法律体系。
At present,there are still problems in the systematic legislation of organized crime punishment in our country,such as conservative ideas,weak systematicness,insufficient operability,lack of guidance of special law,lagging behind of criminal law and related laws and so on. In order to effectively punish organized crime,it is necessary to improve the criminal law and make up the relevant laws. In the improvement of criminal law,it is necessary to accurately define the concept of organized crime and type its criminal composition;position real organized crime as a statutory criminal,improve its criminal content,adjust its level jurisdiction,apply strict enforcement measures,and strengthen related subjects’ legal protection. In terms of complementing relevant laws,it is necessary to scientifically formulate the Organized Crime Law and improve the legal system for three-dimensional defense.
