摘要
目前我国航运保险业在产品设置、服务能力等方面难适应发展需求,迫切需要在保险产品、商业方法方面积极创新。知识产权制度可以有效激励创新,同时充分发挥创新的社会价值,是航运保险创新的最重要保障。一方面应当构建知识产权激励机制,运用体系化思维,综合利用著作权、商标权、商业秘密、保险监管等手段对航运保险产品创新予以激励,同时完善对商业方法创新的专利权激励。另一方面应当完善知识产权交易机制,鼓励创新企业对保险创新进行知识产权交易,同时探索以保险行业协会为主体,建设专门的保险产品知识产权交易平台。
At present, Chinese shipping insurance industry does not yet meet the requirements of development in the respects of production settings, service capability and so on, thus innovation in insurance product and business method is necessary. Intellectual property protection mechanisms, which are the most important protection methods for shipping insurance innovation, can effectively stimulate innovation while making sure its social value. On the one hand, the intellectual property incentive mechanisms should be built to encourage shipping insurance product innovation, by comprehensively using the system of copyright, trademark, trade secret, insurance regulation, etc., while improving the patent incentive of business method innovation. On the other hand, the trading mechanisms of intellectual property shall be perfected, encouraging intellectual property transactions in insurance innovation between innovators. In addition, a dedicated trading platform for intellectual property of insurance innovation shall be established by Shanghai Institute of Marine Insurance.
