摘要
市场经济的高速发展使得市场主体之间的利益关系变得愈发复杂,尤其是售假者和打假者之间的博弈现象已然成为市场秩序健康发展的不稳定因素。基于此种现状,运用全新视角将"知假买假"行为与"赌博"行为相类比,对实践中"知假买假"者的法律属性进行区分,分别认定为"知假买假"的消费者和"知假买假"的非消费者并适用不同的法律规范。同时,若对"知假买假"的消费者适用《消费者权益保护法》第55条的惩罚性赔偿须清晰界定两要件,一为经营者"欺诈"与"欺诈行为",二为经营者"瑕疵担保责任"豁免的例外。最后,在"知假买假"的实务案件中,必须制定相配套的法律制度和灵活运用涉及到的具体法律规范。
The rapid development of market economy makes the interest relationship between market subjects become more and more complicated, especially the game phenomenon between counterfeiters and counterfeiters has become an unstable factor for the healthy development of market order. Based on this situation, this paper uses a new perspective to compare the behavior of " knowing false buying false" with the behavior of "gambling" to distinguish the legal attributes of " knowing false buying false" in practice, and identifies consumers as " knowing false buying false" and non- consumers as " knowing false buying false" and applies different legal norms. At the same time, if we apply the punitive damages of Article 55 of the Elimination Law to consumers who "knowing false buying false", we must clearly define two elements, one is the operator' s "fraud" and "fraudulent behavior" and the other is the exception to the exemption of the operator' s" liability for warranty of defects". Finally, in the practical case of "knowing false buying false", it is necessary to formulate a matching legal system and flexibly apply the specific legal norms involved.
