摘要
2018年3月网络爆出黑龙江某高校的《学生违纪处分条例》,其中的违法性和不当性引发了公众哗然。该事件是因为管理者缺乏基本的法治思维和意识以及缺乏基本的"以生为本"意识而造成的。事件显示加强与提升高校管理者的法治思维仍旧是一个重要的课题。高校管理者应该从以下三个方面着手:认真领会法治的本质和精髓,树立最基本的法治观念、意识和思维,并学会运用这些观念去进行学校内部制度体系的建构或修正;管理者要有意识地对权力进行自我管控;高校管理者需要培养对学生权利的尊重意识,真正贯彻"以生为本"的要求。
In March 2018, the regulations on disciplinary punishment of students of a college in Heilongjiang province were published on the Internet, and the illegality and inappropriateness of the regulations caused a public outcry. The event is caused by the administrators lack of basic thinking and consciousness of the rule of law and the lack of basic consciousness of student-oriented. The event shows that it is still an important task to strengthen and improve the thinking of college administrators on the rule of law. College administrators should begin from the following three aspects: carefully grasp the essence and quintessence of the rule of law, establish the basic concept, consciousness and thinking of the rule of law, and learn to use these concepts to construct or revise the internal system of the school. Administrators should consciously exercise self-control over power. College administrators need to cultivate a sense of respect for students’ rights and implement the requirement of student-oriented.
