摘要
随着网络社会的飞速发展,新型非接触性犯罪呈高发态势。网络的开放性加之电子数据的特殊性,使得非接触性犯罪案件在取证过程中困难重重。面对非接触性犯罪案件中电子数据取证难的现状,应从梳理非接触性犯罪的概念及类型入手,分析非接触性犯罪案件中电子数据的特点,进而对其取证难点进行具体分析,有针对性地从人才、立法、技术、管辖和合作五方面提出解决取证难的对策、建议,有效打击非接触性犯罪。
With the rapid development of the network age,the new type of non-contact crimes are on the rise.Because of the openness of network and the particularity of electronic data,investigators have many difficulties in obtaining the electronic data of non-contact crimes.Facing the truth,the writer analyses the concept and type of non-contact crimes as well as the characteristics of electronic data.Then,the writer analyses the difficulties in obtaining electronic data of non-contact crimes.Finally,in order to break the predicaments and fight against crime effectively,the writer puts forward a series of countermeasures from talents,legislation,technology,jurisdiction and cooperation.
