摘要
侵害我国法益的网络电信诈骗、网络恐怖主义、网络色情、网络赌博、网络贩毒等犯罪在"一带一路"沿线国家逐渐呈现出蔓延之势,电子证据是证明网络犯罪事实的最佳武器。我们一方面要积极推进电子取证方面的刑事司法协作,另一方面也应积极探索电子证据自行取证,但自行取证终究只是权宜之计,还是要回归到刑事司法协作的轨道上来。中国作为"一带一路"倡议发起国,同时作为网络犯罪主要受害国之一,有义务也有能力建立电子取证协作机制。
The crime of internet fraud,cyber-terrorism,internet pornography,internet gambling and internet drug trafficking,which encroach on the interests of our country,gradually spread in the"belt and road"countries.Electronic evidence is the best weapon to prove the facts of cyber crime.On the one hand,we should actively promote criminal judicial cooperation in electronic forensics;on the other hand,we should actively explore electronic evidence to obtain evidence on its own,but self-evidence is ultimately expedient.As a sponsor of the"belt and road"initiative,China is also one of the major victims of cyber crime and has the obligation and capability to establish an electronic forensics collaboration mechanism.
