摘要
法律面前人人平等已是公认的法律原则,对此原则,刑法如何反映和体现是长期困扰刑事立法和刑事司法的难题,本文力图通过刑法的公正与平等观对我国刑事立法和刑事司法的影响,从理论上阐述了刑法平等、公正观的理论根据和现实意义。
Equality is one of fundamental Legal principles.In this article,the author illustrates the influences of equality and justice on our country's criminal legistation and criminal jurisdiction;then he makes deep analyse on the academic theory and the practical effects of equality and justic of criminal law.
