摘要
我国入世文件中对“跨境交付”方式下教育服务国民待遇未作承诺 ,但与这种教育服务有关的国民待遇问题值得关注。WTO《服务贸易总协定》所确立的关于服务贸易的特定的国民待遇原则也适用于这种教育服务。WTO成员可以通过教育服务部门经济一体化、承认等方式选择性地给予“跨境交付”方式下的教育服务以国民待遇 ,以扩大教育服务国际合作。
There is no commitment of national treatment to cross-border supply in educational services in our WTO entry instruments.But this issue shouldn′t be slid over.The national treatment principle established for specific educational service sectors in GATS is also applicable to this kind of educational service.The WTO members can alternatively accord the national treatment to cross border supply in educational services by means of recognition or economic integration in the covered educational sector,and so strengthen international cooperation in the field of educational service trade.
