摘要
中小房地产企业在"野蛮生长"的过程中,存在经营不善、举债过高、资金链断裂等问题,导致企业的经营每况愈下,最终步入破产程序。房企的破产,关系到购房者的切身利益,影响社会的稳定,因此,对于法律赋予破产管理人对合同继续履行或者解除的选择权,管理人应当慎重对待。
The excessive growth of small and medium sized real estate enterprises are often accompanied by poor management, high debt, capital chain rupture and so on. All these can finally lead to the bankruptcy of these enterprises. The Insolvency Law grants the trustees the right to cancel or perform the contract. Therefore, the decision of the trustees is closely relate to the interests of those enterprises and the benefits of the homebuyers and stability of the entire society.
