摘要
1996年国内学者首现对医患法律关系的研究,收集1996～2018年10月期刊中有关医患法律关系研究的所有文献,进行数统分析。数据表明医患法律关系研究主要集中在2002年～2010年,其中医学领域学者对医患法律关系最为关注,但缺乏既有医学又有法学背景的人才对问题进行深度研究;对于医患法律关系属性的定位,主流观点是民事法律关系,也有学者提出为社会法律关系、行政法律关系以及消费法律关系。此外,还有学者认为医患关系不是单一的法律关系,要结合具体案件或就诊的实际阶段来进一步分析。
In 1996, domestic scholars research on doctor-patient legal relationship at the first time. The author collects all the literature on the doctor-patient legal relationship from 1996 to 2018 in China journal, to conduct a comprehensive integration. The results show that most of the researches about the doctor-patient legal relationship are published from 2002 to 2010, medical scholars pay maximum attentions to doctor-patient legal relationship research comparing with others, being lack of talents who have both medical and legal backgrounds. As the positioning of doctor-patient legal relationship, the mainstream view is the civil legal relationship. Other opinions include social legal relationships, administrative legal relationship and consumption legal relationship. There are also some scholars believe that the legal relationship of the doctor-patient relationship is not a single one, which needs to further analyze with the specific cases or phase.
