摘要
美国的立法和司法实践显示,美国对学生网络欺凌的规制以"实施手段以言语欺凌为主""实施时间和地点无限制"和"旁观者助长欺凌效应"等特征作为前提,规制的逻辑基础是学校对学生的言论规制权。在规制范围方面有限且适度,既要维护社会公共利益又要兼顾保障学生的言论自由;在规制模式方面,推行以社会共治为主、政府干预为辅的协同监管模式。
Drawing upon the statute and the case in the U.S., this paper attempts to uncover the legal prerequisite, logic, scope and the cooperative supervision model. The prerequisite of the regulation is regarding language bullying as the major form, unconstraint of the time and place, etc. The logic basis is the school's speech regulation power on students. The regulation is limited and reasonable to avoid conflict of speech freedom of students. The regulation model is a collaborative regulatory model that focuses on social governance and is supplemented by government intervention.
