摘要
本文采用契约治理分析范式,以显性契约与隐性契约为着力点,构建了＂三权分置＂下小型农田水利治理＂禀赋特征——产权结构——契约选择＂的分析框架,指出小型农田水利禀赋特征影响产权结构安排,导致小型农田水利治理显性契约和隐性契约组合关系选择不同。通过3个典型案例分析发现,在土地流转程度较高的地区,小型农田水利显性契约对隐性契约的替代程度越高,并沿着弱显强隐、中显中隐、强显弱隐的契约组合关系演变。需要通过契合禀赋特征、明晰小型农田水利产权结构、把握契约强度、推动小型农田水利契约显性化等方面提升小型农田水利整体治理水平。
This paper adopts a contractual governance analysis paradigm,with explicit contracts and implicit contracts as the focal points,establishes an analysis framework of the ＂endowment characteristics—property right structure—contract choice＂for small-scale irrigation and water conservancy governance under ＂Three-Power Division＂,and points out that the endowment characteristics have an effect on property right structure,which in turn leads to different choices of the combination relationship betweenexplicitcontractsandimplicitcontractsinsmall-scaleirrigationandwater conservancy.Through the analysis of three typical cases,the higher degree of farmland transfer is,the higher degree of substitution of implicit contracts with explicit contracts are.The evolution of contractual combinations change along with the lines of weak explicit and strong implicit,medium-explicit and medium-implicit,strong explicit and weak implicit contracts.It is necessary to improve the overall governance level of small-scale irrigation and water conservancy by means of meeting the endowment characteristics,clarifying the property rights structure,grasping the strength of the contract,and promoting the explicit contracts.
