摘要
法庭言语近年来逐渐发展为显学。法庭言语的说服力是法庭上胜诉的决定性因素。从语用学视角探讨法庭言语的取效行为可以丰富该领域的研究。本文以关联理论为框架,以四部英美剧中的法庭话语为语料,探讨法庭言语的特征、语力及取效行为。研究发现,法庭言语包含充足的案件法律事实,其他方的言语参与以及影响范围的扩大,使之涉及到一个群体。因此,丰富的法律事实+他人的参与程度+将影响对象扩大为群体=具有说服力的法庭言语。
Courtroom speech has gradually developed into a noted doctrine in recent years. The persuasiveness of courtroom speech is a decisive factor in winning the lawsuit. The exploration of the perlocutionary act of courtroom speech from the perspective of pragmatics can enrich the studies in this field. This dissertation, based on the Theory of Relevance, takes the courtroom discourse in four Anglo-American TV series as data to explore the characteristics, illocutionary force and perlocutionary act. The study finds that the courtroom speech contains sufficient legal facts of the case, the verbal participation of other parties and the extension of the scope of infuence, which concerns a certain group. Therefore, abundant legal facts ＋ the degree of participation of others ＋ the extension of the scope of infuence - persuasive courtroom speech.
