摘要
针对转基因食品的规制争议,本文介绍了美国和欧盟分别作为"挺转"和"反转"代表的不同规制方式,包括前者的放松规制和后者通过"新食品法"以及单行转基因食品法律的审慎规制,进而进一步探讨了目前转基因食品监管中在国际层面得到认可的科学原则和依旧处于争议中的谨慎预防原则。最后,结合中国本身的国情,论述中国转基因食品规制的现存问题以及反思转基因食品规制中如何利用国外的经验制定适合中国的具有前瞻性的转基因食品规制模式。
When it comes to the dispute on the regulation of Genetically Modified Food(GM food),the United States of America and the European Union represent the different models,respectively.Generally,the former is "for the GM food" through the deregulation while the latter "against the GM food" by applying new food regulation and specific regulations regarding GM food in precautionary way.Through an overview,this paper further discusses the scientific principle which has been commonly recognized at international level for regulating GM food and the precautionary principle which is still a disputable subject.Finally,based on China's national conditions,this paper presents the current gaps in the regulation of GM food in China,and discusses construct a proactive regulatory model on GM food in China through learning from foreign experience.
