摘要
党的十九大作出了将深化国家监察体制改革试点工作在全国推开的决策部署。其中,用留置取代"两规"措施作为依法赋予监察委员会职责权限的关键性举措而备受关注。留置取代"两规"虽是一词之变,但反映依法治腐从党内逐渐推向国家层面的重要过程,意味着反腐败工作全面纳入法治轨道上了一个新的台阶。为此,我们约请国家社科基金特别委托项目《中国特色社会主义监察制度研究》课题组的专家、学者,围绕留置措施在监察体制改革试点中的运用、用留置取代"两规"措施具有怎样的法治意义、留置措施如何规范实施等问题展开笔谈,以期引发读者的思考。
At the party's Nineteen National Congress, decisions have been made to deepen the pilot work of the national supervision system reform throughout the country. Among them, " Replacing Double Designation measures with Detaining "as a key measure to empower the Supervisory Committee according to law has attracted much attention. Although the replacement of " Double Designation by detaining" is a change of the word, but it reflects the important process of governing corruption in accordance rule of law from within the party to the national level gradually, which means that anti-corruption work has been fully incorporated into the rule of law track to a new level. To this end, we invited experts and scholars from the National Social Science Fund specially commissioned Project——"Study on Socialist Supervision System with Chinese Characteristic" group to engage in writing discussion regarding the use of detaining measures in pilot reform of supervision system, the rule of law significance of replacing Double Designation with Detaining, how to regulate the implementation of replacing Double Designation with Detaining and other issues, in order to stimulate the reader's thinking.
