法官绩效考评制度的法理基础与变革方向 被引量:20

The Legal Basis and the Changing Direction of Judge's Performance Appraisal System

摘要 法官绩效考评制度是以现代科层制与程序正义作为构筑基础,由于指标设计、实现路径等不足,对法官行为形成了干扰,影响了司法公正实现,但构成要素的不足不能成为否定绩效考评制度的理由。司法管理(绩效考评制度)与司法审判都是司法权的有机构成,两者互为支撑,都是司法权顺利运行的保障机制。尽量降低绩效考评制度对员额制改革、审判权运行机制改革的负功能,应是研究的重点;减少绩效考评制度对法官独立审判的干扰,提高指标的合法合理性,优化制度实现的路径,构成研究的难点。重视整体性方法、反思考评制度的过度工具理性、综合运用多学科知识,是考评制度得以优化的基本对策。 Judge performance evaluation system is based on modern bureaucracy and procedural justice as the basis of the design, the realization of the path and other deficiencies, the formation of the interference of the judge's behavior, affecting the judicial justice to achieve, but the lack of elements can't become a negative reason. Judicial managementand judicial trial are the organic composition of the judicial power, both support each other. It is the focus of the research to reduce the interference of the perform- ance appraisal system on the independent trial of the judges, to improve the legitimacy of the indicators and to optimize the path and composition of the system, so as to reduce the performance of the system. It is the basic countermeasure that the performance appraisal system can be optimized by emphasizing the whole method, reflecting the excessive instrumental rationality of the per- tbrmance appraisal system and synthetically using the multidisciplinary knowledge.
