摘要
重大贪污、受贿罪终身监禁的立法规定,是"废除死刑"国际趋势与严厉惩处腐败犯罪刑事政策"中和"的结果。无论是从刑法内部基本原则还是外部刑事一体化链条,乃至合宪性手段等方面进行分析,当前我国终身监禁的刑事立法规定均存在形式与实质方面合理性的不足。借鉴域外已有经验并结合当前我国刑事政策与刑事立法的具体情况,死缓期间"重大立功表现"具有排除终身监禁实际适用之功能。参考《刑法》第五十条第二款限制减刑的立法方式,治愈了当前终身监禁形式上合理性不足的基础上。立足我国死刑改革的大局,适当扩张我国终身监禁的适用对象范围,将是合理的选择。此外,假释、赦免等刑罚回归制度的启用,成为完善当前我国绝对终身监禁的适当路径。
It is the ＂neutralization＂ result of the international trend of abolishing the death and the severe punishment of the criminal policy of corruption that the legislate provisions of the life imprisonment for the crime of corruption and bribery. Both from the basic principle of the interior of the criminal law and the criminal integration chain, even the constitutionality of were analyzed of the outside of the criminal law, the current criminal legislation of the life imprisonment lack of formal and substantive rationality. Learning from the experience of the region and combine the details of criminal policy and criminal legislation of our country, we should be sure that the ＂significant performance＂ during the period of the death sentence excludes the function of life imprisonment. Besides, we should cured the current situation of life imprisonment in the form of insufficient rationality, on the basis of referring to the second paragraph in article fifty of the Criminal Law. It is a reasonable choice that standing in the big picture of the reform of the death penalty in our country to expand the scope of application of the life imprisonment for life in China. In addition, the implementation of the return system of parole and pardons is an appropriate way to improve the absolute life imprisonment of our country.
