摘要
黔南涟江流域是布依族比较集中的聚居地方之一。近十年间,本文作者承担多个社科研究课题,对涟江上游流域的布依族习惯法进行田野调查。1990年代以前,布依族习惯法是维护当地社会秩序的重要规范之一,起着非常重要的作用。习惯法的表现形式主要是祭祀神庙时制定的规范、历史传统规范以及依据国家法制定的村规民约中体现的习惯法内容等。习惯法的内容主要是民间财产性处罚规范、婚姻习惯法规范、民间寨老调解制度等。
The Lianjiang River watershed of Qiarman Buyi and Miao Autonomous Prefecture is where the Buyi people live mainly. In the past decade I made a fieldwork survey on the folk law of the Buyi people in the Upper Reaches of Lianjiang River, sponsored by a number of scientific research projects. Since the 1990s the folk law of the Buyi people has been playing an important role in maintaining local social order. It is found that the folk law is mainly expressed in the religious temple service norms, historical traditional norms, and the local villagers＇ regulations based on the state law, covering such aspects as folk property penalties, marriage conventions, and the village head reconciliation system.
