摘要
《档案法》修订草案中的档案定义存在诸多值得商榷之处，建议尊重学理定义，体现档案本质属性，避免循环定义，防止《档案法》调整范围的过度扩张。《档蒜法》修订草案的语言表述过于随意，建议同一概念前后表述保持一致，避免使用非专业术语、不常用概念，克服口语化倾向，注重立法语言的逻辑性。
There is a lot of discussion on the definition of the archives in the revised draftof the ＂Archives Law of the People＇s Republic of China ＂. It is recommended to respect the definition according to academic principle, to reflect the essential attribute of the archives, to avoid the circular definition and to prevent the excessive expansion of theadjusting rangeof the ＇＂ Archives Law of the People＇s Republic of China ＂. The expression of the revised draft of the Archives Law is too arbitrary. So it is recommended that the same concept should be consistent according to the context, to avoid the use of non-professional terms, not commonly used concepts, to overcome the tendency of colloquialism and to pay attention to the logic of language expression.
