摘要
英文合同分隔结构作为一种独特的专门英语语言现象可以视为为实现合同正义原则而服务的,即权利义务合理分配并体现公平正义。本文以菲迪克《总承包工程合同条件》为对象,采用描述分析的方法,从信息焦点和法律语言的"单义性"角度阐释了英文合同分隔结构的法理合理性,即如何实现合同正义原则。
As a special linguistic phenomenon of English for special purpose,discontinuous phrase in English contract can be viewed as an instrument serving for justice principle of contract,i.e.,the reasonable allocation of rights and obligations,and the realization of justice and fairness.From this perspective,this paper,based on FIDIC＇s ＂Conditions of Contract for EPC/Turnkey Projects＂,justified the legal rationality of discontinuous phrases,i.e.,its realization of the principle of justice of contract,from the standpoint of information focus and the monosemy of legal language.
