摘要
我国目前的高等教育办学结构基本上形成了以公办高校为主体,以民办高校为有益补充的健全体系。两类高校的内部治理结构均以"校长负责制"为核心,在细微制度设计上存在差别。此种内部治理结构的设置存在一定缺陷,造成了公办高校的行政化现象和民办高校的私益化现象,应当作出法制改进。未来应当形成学术与行政分权制衡的新型高校内部治理结构,公办高校和非营利性民办高校均应当充实高校学术委员会的职权,形成与校长之间的分权制衡;而营利性民办高校则应当直接采用公司制企业法人的内部治理结构。
China's current higher education structure of the school has basically formed the sound system that public colleges and universities act as the main body;Meanwhile,the private colleges act as a useful complement. The internal governance structure of the two types of colleges and universities are based on the "principal responsibility system"as the core. There are differences in the subtle system design. This kind of internal governance structure has certain flaws,which causes the administrative phenomenon of public colleges and universities and the privatization of private colleges and universities,and the legal system improvement should be taken. The new internal management structure of academic and administrative decentralization checks and balances in colleges and universities should be established in the future. The public colleges and non-profit private colleges and universities should enrich the authority of the academic committee to form checks and balances between the committee and the principals; The profit private colleges should directly adopt the domestic governance structure of the corporation.
