摘要
教材类作品应当在多大程度上享有著作权的保护在出版实践中存在着较大争议。教材类作品的功能性和标准性等特征使教材在表达的选择空间上低于其他类型作品。因此,与其他类型作品相比,应对教材类作品著作权进行更大程度的限制。可以通过教材类作品相关市场的界定及禁令救济限制两个具体维度来展开对著作权范围的限制。
There exist some disputes with respect to protection limits for textbooks in publication practice. For textbooks, their expressing choices will be limited to a more extent because of intrinsic functional and standard characteristics. Therefore, copyright scopes of textbooks should be defined more narrowly, compared with other kinds of works. The copyright scopes of textbooks may be restricted by means of relevant markets definition and limiting the injunction remedies.
