摘要
民法典婚姻家庭编的修订工作正在进行中,全国人大常委会法工委近日召开了第一次专家研讨会,讨论应当修订的主要问题。民法典婚姻家庭编通则规定的亲属基本制度,以及配偶关系、亲子关系和婚姻财产关系,都有若干重大问题需要研究解决,在立法上进行改革,以使我国的婚姻家庭法律制度改变目前由《婚姻法》《收养法》构建起来的,规则比较简陋、与现实社会生活和世界主流民法亲属制度相脱节的规则体系,构建符合社会实际生活需要、与世界主流民法的亲属法律制度相衔接、具有中国特色的我国婚姻家庭法律制度。对其中存在不足、急需立法修订的主要问题,本文提出了具体的立法建议。
The revision of the Marriage and Family Compile of the Civil Code Law is underway. The Law Committee of the Standing Committee of the National People＇s Congress （NPC） has held its first expert seminar recently to discuss the main issues that should be revised. There are a number of important issues that need to be studied and solved in the legislation of the general rules in the Marriage and Family Compile of the Civil Code Law, such as the basic system of relatives, spousal relationship, parent-child relationship and matrimonial property. We need to reform the simple rules based on the Marriage Law and the Law of Succession, which are not conform to the reality of social life and the world＇s mainstream domestic relationship of civil legal system, and to make China＇s Marriage and Family Legal System meet the needs of the actual social life, and connect to the world＇s mainstream domestic relationship of civil legal system. This paper presents specific legislative proposals on the main questions which are urgent to be revised.
