摘要
人格权制度的勃兴是现代民法最为重要的发展趋势,从世界范围来看,各国都普遍强化了对人格权的保护,我国也不例外。我国正在制定的民法典应当将人格权独立成编,这不仅是有效应对科技进步和社会发展的需要,也是全面保护人格尊严的要求。人格权独立成编有利于完善我国的民法体系,解决人格权的民法规范难题。人格权独立成编具有充分的实践基础和价值基础,而且能够解决我国人格权保护的现实问题。通过人格权独立成编,将使我们民法典真正成为一部科学的、能够屹立于世界民法典之林的、面向21世纪的民法典。
The rise of personality right law is the most important development trend of modern civil law.From a global perspective,most countries have generally strengthened the protection of personality rights,and China is no exception.The China＇s Civil Code,which is being developed,should take the Personality Right Law as an Independent Part.This is not only an effective response to the needs of scientific and technological progress and social development,but also a requirement for comprehensive protection of human dignity.The Independence of Personality Right Law is helpful for the improvement of the Civil Law System,and is helpful for solving the difficulties of protecting personality rights in civil law.The independence of Personality Right Law has sufficient practical basis and value basis,and is helpful for protecting personality rights in judicial practice.By taking the Personality Right Law as an independent part in the Civil Code,we will make our Civil Code truly a scientific,able to stand in the world civil code forest,and a 21 st century civil code.
