摘要
刑法的规范确证机能,也就是传统理论当中的"规制机能",对于人权保障和法益保护而言,具有前提性意义。将规范确证机能作为当下我国刑法的首要社会机能,不仅具有历史合理性,也具有合时代性。强调并实现"法公正"是确证机能实现的保障条件,同时应当避免规范宣吁不当、规整手段选择不当和刑法适用异化等问题,以保证刑法的运行能够在引导守法意识的内生性养成方面发挥有效的作用。
The norm-confirmation function of criminal law is fundamental for protection of human rights and legal interest.To take norm-confirmation as the essential social function of China’s criminal law is perfectly reasonable from the viewpoint of both history and modern society.Fairness is an important prerequisite for actualizing criminal law’s norm-confirmation function.Meanwhile,we should prevent potential side effects so that criminal law can also play a role in developing citizen’s lawabiding consciousness.
