摘要
我国现行失业保险制度和政策运行实践表明其具有社会救助和社会福利属性,这不符合社会保险的制度原理。我国失业保险制度的改革应当使其回归社会保险的制度原理,变革为就业保险,重溯制度目标,实现制度更迭:构建保生活、促就业、防失业三位一体的制度目标模式,其中生活保障是基础,促进就业是核心,预防失业是补充;完成从失业保险向就业保险的制度转化,建立实现制度目标的三项就业保险给付;完善促进就业导向的失业给付制度,将职业介绍补贴和职业培训补贴制度改造为就业给付制度,建立经济不景气时期的缩短工时工资补贴制度。
The operation of current legal system and policy indicate that unemployment insurance is considered to be social relief and welfare, which conflicts with the principles of social insurance. We should return to the theory of social insurance, reshape the institutional goals, and reform employment insurance. In order to realize the employment insurance, the institutional goal model should integrate three goals： basic living protection, employment promotion, and unemployment prevention. Among these three goals, living protection is basic, employment promotion is central, and unemployment prevention is complementary. To achieve these three goals, three employment insurance benefits should be established, that is, unemployment benefits, employment benefits and employment stability benefits.
