摘要
国际争端解决机制是国际社会所普遍渴望的人类良知、理性及对公平正义追求的制度化结晶,是确保国际社会和平与安全,推进人类迈向更加美好社会的坚强后盾,更是国际法实施机制的重要组成部分。国际争端解决机制将在多样性与反碎片化同步发展、国际争端主体范围扩大、国际争端解决融合、透明化、规则导向、组织化等方面进一步演化。这些演进趋势体现了国际法治已经进入到一个不可逆转的螺旋式上升轨道。当前国际社会种种挑战国际法的不利因素必将成为国际法治进一步完善的动力,而一带一路战略的逐步推进和人类命运共同体的构建必将给国际法治指明进一步发展的方向。国际争端解决机制的进一步演进必将在推动国际社会法治化发展的同时,也成为推动一带一路战略稳步实现、人类命运共同体逐步构建的坚强保障因素。
The international dispute settlement mechanism is the institutionalized result of human con-science ,rationality and the pursuit of fairness and justice universally desired by the international community. This is a strong supporter for ensuring peace and security and even an important part of the implementation mechanism of international law. The international dispute settlement mechanism will be further developed with the develop-ment of diversity and anti-fragmentation, the expansion of the subject scope of international disputes, the inte-gration and transparency of international disputes, the rule-orientation and the systematization of international disputes. These trends show that the international rule of law has entered an irreversible spiral of upward orbit. At present,the negative factors of international law will become the driving force for further improvement of it. The construction of ＂The Belt and Road＂ initiative and the common destiny of mankind will indicate the direction of further development of international law. Anyway, the further evolution of the international dispute settlement mechanism will certainly promote the legalization of society,and become a strong guarantee of the ＂The Belt and Road＂ initiative and the common destiny of mankind.
