摘要
新浪诉脉脉案的判决引发社会广泛关注,它暴露出大数据时代个人信息保护中ISP责任制度存在的问题。该案是当前我国个人信息保护状况的"试金石",判决可以推动对ISP责任制度缺陷及其完善的思考。不过,通过对国外个人信息保护理念及发展趋势的考察之后可以发现,我国对于个人信息的保护目前仍然停留在传统的个人信息保护的观念和制度上,今后,个人信息保护制度的建设应进一步加强对于ISP责任制度的建构。
The judgment of ＂Sina sued Maimai＂ case has attracted social attention, and it has exposed the problems of ISP liability system in personal information protection in the era of big data. The case is the touchstone of the current situation of personal information protection in China, which can promote the reflection of the defects of ISP responsibility system and its improvement. However, it can be found after studying the concept and development trend of personal information protection in foreign countries, china＇s protection of personal information is still stuck in the traditional concept of personal information protection and system. In the future, the construction of personal information protection system should focus on the use of personal information, to strengthen the responsibility of the ISP system.
