摘要 发行会员卡已成为商家吸引消费者,盘活流动资金的重要销售手段,市场上商家发行的如积分卡、打折卡、健身卡、美容卡等都属于会员卡的形式。商家通过会员卡赋予顾客的"身份",其中部分会员卡还具有储值的功能。目前,经营者无需履行任何手续,即可任意发行会员卡,给消费者带来便利的同时,给消费者的资金安全和个人信息保护带来了一定的安全隐患。从制度上和法律上有效规制会员卡发行及运行制度,有利于维护市场交易的安全、稳定,也有利于消费者财产权和个人信息安全的保护。 Membership card has been an important sales enticement that sellers use to attract consumers and activate their working capital. Currently, the cards available on market including point cards, discount cards, fitness cards and beauty cards are all member- ship cards. By membership cards, sellers give an "identity" to their customers. Some membership cards can be also used as a stored -value account. However, in addition to the convenience for consumers, membership cards also have some potential risks in consum- ers' fund security and personal information protection, since it can be issued by sellers without going through any formality. Therefore, to maintain safe and stable market transactions and protect the property rights and personal information security of consumers, it is nec- essary to regulate the issuing and operation system of membership card effectively from an institutional and legal perspective.
