摘要
领导立法工作是中国共产党治国理政的重要内容,与依法治国、依法执政、依规治党呈现相辅相成、相互促进的关系。在依法治国与制度治党、依规治党统筹推进、一体建设的视野下,应当明确党领导立法工作具有法治意义上多重性质,必须依据党规国法进行,限于党中央和有立法权地方的党委的组织行为,与人大主导立法不相冲突等基本逻辑;除提出宪法修改和解释建议、审定立法规划和立法计划、重大立法事项研究决策等路径外,还应当积极推动党内法规与国家法律的衔接协调,相应地完善或创新发展重大立法事项请示报告和工作汇报制度、立法公众沟通机制、党规国法衔接协调机制、法规规章和规范性文件备案审查衔接联动机制等制度机制,并适时制定党领导立法工作的基础主干型党内法规。
Leadership over legislative work is an important part of governance by the Party, together with rule of law, law-based State governance and rule-based Party governance, they supplement and promote each other. In the process of unified and coordinated progress of the rule of law and rule-based Party governance, it is essential to clarify that, the Party＇ s leadership over legislative work, in view of the multiple legal significance it bears, must conform to following basic logic： must be in accordance with the inner Party regulations and national legislations; must be limited to organizational behaviors of the Party Central Committee and the Party committees from places with legislative power; must be in no contradiction with the People＇ s Congresses who enjoys legislative power to lead legislative work. Except for proposing suggestions for constitutional amendment and interpretation, examining legislation program and plan, and policy-making concerning major issues in legislative work, we should also actively promote the cohesion and coordination between the inner Party regulations and national legislations. Furthermore, boost the perfection and innovative development of the mechanism for asking for instructions and making reports for major legislative issues; formulate legislations on the mechanism for the Party and legislative bodies to communicate with the social public, the mechanism for cohesion and coordination between the inner Party regulations and national legislation, the mechanism for coordinating the recording and review of regulations and normative documents, and enact fundamental and specialized inner Party regulation of the Party＇s leadership over legislative work at appropriate time.
