摘要
新业态从业人员是我国新兴的一种就业形态,也是国家倡导的一种就业形式,对于这一类职业人群,应当给予工伤保障的制度安排,以保护灵活就业人员的职业伤害权益。但现阶段,不宜将灵活就业人员纳入现行的工伤保险制度中,建议在工伤保险制度框架下,建立重大职业伤害保险,重点解决灵活就业人员的伤残和工亡的保障问题。这样做,可使灵活就业人员职业伤害有制度性安排,保障其工伤保障权益;可在一定程度上降低灵活就业人员的工伤保险费率,减轻其缴费负担;可以规避灵活就业人员工伤认定难。
Employees in new formats should provide institutional arrangements for industrial injury protection so as to protect the occupational injury rights of them. But at this stage, we should not put the fl exible employment personnel into the current industrial injury insurance system. We propose to establish a major occupational injury insurance under the framework of the industrial injury insurance system, solving the problem of the disability and death of the fl exible employees.In this way, it can protect the fl exible workers＇ interests in industrial injury insurance. To a certain extent, it can reduce the rate of work-related injury insurance for fl exible employees and lighten their burden of payment. It can avoid the difficulty of finding work-related injuries and the lack of responsibility of employers in fl exible employment.
