摘要
由于互联网行业的快速发展,反垄断法的现有规定难以对具有交叉网络外部性特征和封闭效应的网络分享平台企业的掠夺性定价行为进行准确认定。而通过借鉴美国和欧盟在双边市场反垄断的法律规定和判案经验,我国可以在认定网络分享平台企业掠夺性定价时,考虑在确认具有市场支配地位的前提下,平台企业是否实施了低于成本的销售行为,而且平台企业是否具有排除、限制竞争的目的应成为判断其是否实施了掠夺性定价的主要考量因素,这一主观判断亦可配合客观标准来进行认定。据此,网络分享平台企业的掠夺性定价行为的判断结果更为公正、合理及节约成本。
With the rapid development of the Internet industry, it is diffcult to accurately identify the predatory pricing behavior of the network sharing platform with the characteristics of cross network externalities and the closed effect. By drawing on the legal provisions and the trial experience in the bilateral market of antimonopoly in the United States and the European Union, our country can determine the network sharing platform of enterprise of predatory pricing through considering whether it has a dominant market position and the implementation of the sales below cost, and purpose of the eliminate or restrict competition. What’s more, the subjective judgment can also work with objective criteria to identify. Accordingly, the predatory pricing behavior of the network sharing platform can be more fair, reasonable, and cost savings.
