摘要
对中国网络食品监管最新亮点进行了全方位解读。《食品安全法》于2015年新修订,首次引入网络食品交易第三方平台提供者相关规定,为进一步细化网络食品交易规则,保障网络食品安全,2016年7月14日,国家食品药品监管总局正式发布《网络食品安全违法行为查处办法》。本办法于2016年10月1日起施行,包括总则、网络食品安全义务、网络食品安全违法行为查处管理、法律责任、附则等五章四十八条。本办法强化平台和入网食品生产经营者义务和法律责任,为网络食品市场的有序运行提供了制度上的保障。
To fully implement the Food Safety Law and to well regulate online food business practices to ensure food safety, China Food and Drug Administration issued the Measures for Investigation into Online Food Safety Illegal Activities on July 14, 2016. The Measures were in effect on October 1, 2016, comprised of 5 chapters totaling 48 articles including General Provisions, Online Food Safety Obligations, Investigation into Online Food Safety Illegal Activities, Legal Liabilities and Supplementary Provisions. The Measures are to strengthen food safety compliance of third party online food platform and online food business operators to ensure a well regulated online food trading system by providing sound legal institutions.
