摘要
政府与行政审批中介的应然关系是我国深化行政审批中介机构改革亟须厘清的问题。通过对美国有关法律规范的研究,本研究系统梳理了美国社会投资建设工程领域行政审批中介的构成、行政审批流程中的中介角色,以及政府对行政审批中介的管理制度。研究指出,美国对政府与行政审批中介关系的制度设计比较巧妙,既发挥了市场对资源及定价的调配作用,又实现了政府对行政审批中介的管理,政府还与行政审批中介达成合作关系。对制度分寸的准确把握与拿捏,使得政府在提高审批效率的同时,更好地行使了行政审批权。美国经验对我国现阶段改革或有借鉴意义。
The exploration of relationship between government and administrative-approval-intermediaries is essential for deepening administrative approval reforms in China. This article analyses the composition of administrative-approval-intermediaries in the US in private construction projects,their roles,and the government regulation system. It argues that market is active under proper regulations from the government who achieved cooperation with intermediaries. Experiences from the US may provide references for China's reform.
