摘要
培育发展团体标准是我国标准化体制改革的重要内容,团体标准化组织能够实现自我治理,也需要法律规制。本文首先探讨了团体标准自我治理的理论基础,分析了团体标准自我治理的法人主体资格、组织活动规则,以及知识产权政策等机制规则,并研究了团体标准自我治理的政策引导和法律规制问题,最后得出了研究结论。
The cultivation and development of group standards is an important part of the standardization work reform in our country. Group standardization organizations can achieve self-governance, but they need legal regulation as well. This article discusses the theoretical basis of self-governance of group standards, analyzes the mechanisms of self- governance of group standards such as legal subject qualification, organizational activities rules and intellectual property policy, studies the policy guidance and legal regulation to self-governance of group standards, and draws the conclusion.
