摘要
以霾污染为代表的区域性复合环境污染已成为我国进入环境污染累积期和高发期的标志。区域性复合环境污染的客观成因主要与污染累积和污染叠加、污染避难所的存在以及污染流域的形成有关。我国在区域性复合环境污染防治立法及其实践中还存在诸多不足,应当在借鉴国外有关法律经验的基础上对现有的防治法律对策体系进行完善:将以单一介质和单一因子为基础的传统污染防治模式转变为动态的综合防治模式、完善以环境质量为目标的区域联防联控机制、构建以环境责任追究为目标的跨区域环境诉讼机制、强化源头治理及落实属地管理责任。通过上述机制和制度的严格落实倒逼产业和能源转型,并真正保证公众参与,在污染防治方面实现管制和治理的结合,最终使区域性复合环境污染防治取得实效。
Regional combined pollution of environment with haze pollution as a typical example symbolizes that our country has entered into a period of increase in the accumulation and occurrence of environmental pollution. We should improve our existing legal countermeasures to prevent and control regional combined pollution of environment by changing the traditional prevention and controlling mode based on one single medium and one single factor into a dynamic and comprehensive prevention and controlling mode, improving the inter -regional mechanism of joint prevention and control with the quality of environment as the goal, constructing the system of cross- regional environmental litigation for environmental accountability, and strengthening the source control and implementing territorial management responsibilities. Strict implementation of the above -mentioned mechanism and system will bring about forced industrial and energy transformation, ensure the public participation, help combine regulation and governance in pollution prevention and control, and bring practical results in pollution prevention and control.
