摘要
气候变化问题仍是国际关系中需要全球性治理的综合问题,更是协调国际社会集体行动的国际法议题。自1994年生效《联合国气候变化框架公约》和2005年生效的《京都议定书》到2015年达成《巴黎协定》,以联合国为主导的全球气候治理经历了24年多的曲折发展。国际减排规则已从京都机制下的自上而下的模式转型为巴黎机制下"自下而上"的模式。未来国际法的发展将在责任转型、大国共治、软法治理等层面深刻影响并推动全球集体减排行动的一致性展开。
Climate change is still a comprehensive problem that requires global governance in international relations, and it is also an international legal issue to coordinate the collective action of the international community. From the United Nations Framework Convention on climate change、＂Kyoto Protocol＂ to the Paris Agreement, The international emission reduction rules have been transformed from the top-down model under the Kyoto mechanism to the ＂bottom up＂ model in Paris mechanism. The development of international law in the future will be responsible for the transition of responsibility, governance of great powers, soft law governance to promote global collective action.
