摘要
在界定铁路和民航规章比较研究范围的基础上,首先,从规章体系发展历史、规章分类方式及规章体系结构3个方面对铁路和民航2种不同运输方式的规章体系进行比较分析;其次,从规章的制修订管理、规章规范性和时效性、规章管理信息化3个方面对规章管理方式进行比较分析;最后,对铁路规章体系建设和管理提出相关建议和意见,即建立政企分开条件下的铁路规章管理机制、加强铁路规章管理的规范化水平、加快铁路规章国际化进程、整合既有规章管理系统。
Based on defining the research area of regulation for railway and civil aviation industries, this paper carries out comparative analysis of regulation system between two transport modes railway and civil aviation from perspectives of development history, classification, and regulation system, and comparative study of regulation management between two transport modes from perspectives of formulation and revision management, regulation standarization and timeefficiency, and management informationization, and finally proposes suggestion for the construction and management of railway regulation system, including building railway regulation management mechanism based on separation of government function from enterprise management, strengthening management level of railway regulation, speeding up internationalisation process of railway regulation, and integrating existing regulation management system.
